These terms are an agreement between you and [LEGAL BUSINESS NAME], registered at [REGISTERED ADDRESS, CITY, STATE, PIN] (“we”, “us”), which operates Prep with Nidhi (the “platform”). By creating an account or using the platform you agree to them, and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the platform.
1. The service
Prep with Nidhi provides online IELTS practice: timed mock tests for Listening, Reading, Writing and Speaking, with Writing and Speaking marked by human teachers and examiners. Students use it either through a coaching institute that has arranged access for them, or on their own by signing up directly.
2. Not affiliated with IELTS test owners
IELTS is jointly owned by the British Council, IDP: IELTS Australia and Cambridge University Press & Assessment. Prep with Nidhi is an independent practice platform and is not affiliated with, endorsed by or connected to any of them. Our tests are original practice material written in the IELTS format; the band scores we give are estimates to guide your preparation, not official results, and do not guarantee any score in the real test.
3. Your account
- You sign in with a one-time code sent to your email. Keep access to that email secure — anyone who can read it can sign in as you.
- Give accurate details, and use only your own account. Accounts are personal and may not be shared.
- If you are under 18, you may use the platform only with the consent of a parent or lawful guardian.
- Tell us promptly at [SUPPORT EMAIL] if you think someone else has used your account.
4. Acceptable use
When using the platform you agree not to:
- copy, record, scrape, publish, sell or share test questions, audio, passages or model answers;
- submit someone else's work as your own, or have someone else take a test for you;
- upload anything unlawful, abusive, obscene or that infringes someone else's rights;
- try to access accounts, data or parts of the platform you are not permitted to;
- interfere with, overload, reverse-engineer or probe the security of the platform;
- harass or abuse teachers, examiners, staff or other users.
We may suspend or close an account that breaks these rules, after notice where reasonable.
5. Coaching institutes
If you are an institute giving your students access to the platform, you also agree that:
- you have a lawful basis, and any consent required under the Digital Personal Data Protection Act, 2023 (including verifiable parental consent for students under 18), to enrol each student and to have us process their data on your behalf;
- you will tell your students how their data, including Speaking voice recordings, is used, and pass on to us any request they make to access, correct or delete it;
- you are responsible for the people you give teacher or admin access to, and for keeping student data you download from the platform secure;
- any separate written agreement between you and us (covering pricing, seats, service levels or data processing) takes priority over these terms where they differ.
6. Payments
- Prices for individual learners are shown in Indian Rupees on our pricing page and include applicable taxes unless stated otherwise.
- Packs are one-time purchases — there is no subscription and no automatic renewal. Payments are processed by Razorpay; we never see your card, UPI or bank details.
- Access is activated once payment is confirmed. The number of mock tests and any validity period are as described on the pricing page at the time you buy.
- Refunds are covered by our Refund Policy. Institutes are billed as agreed with them separately.
7. Content and intellectual property
The platform, its design and software, and all tests, questions, audio, passages, model answers and feedback templates are owned by us or our licensors and protected by copyright. We give you a personal, non-transferable licence to use them for your own IELTS preparation while your access lasts.
You keep ownership of your own answers, essays and recordings. You give us permission to store, process and show them to your institute and to the teachers and examiners marking your work, only to provide the service and as described in our Privacy Policy.
8. Marking and feedback
Writing and Speaking are marked by people using their professional judgement. We aim to return results within the times we state, but turnaround can vary with demand. Marks and feedback are for practice and may differ from the score you receive in an official test.
9. Availability and changes
We work to keep the platform available and your work saved, but we cannot promise it will always be uninterrupted or error-free — for example, during maintenance or if your internet connection or browser fails during a test. We may improve or change features over time; if a change significantly reduces something you have already paid for, we will offer a fair remedy under our Refund Policy.
10. Liability
The platform is provided “as is” for exam practice. To the extent the law allows, we are not liable for indirect or consequential losses — such as a missed admission, visa or job outcome, or your result in an official IELTS test. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits any right you have that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.
11. Ending your use
You can stop using the platform at any time and ask us to delete your account by emailing [SUPPORT EMAIL]. If you joined through an institute, your access also ends when the institute removes you or its arrangement with us ends. We may suspend or close accounts that break these terms.
12. Governing law and disputes
These terms are governed by the laws of India. We would always rather sort out a problem directly — please contact us first. Any dispute that cannot be resolved that way is subject to the exclusive jurisdiction of the courts at [CITY FOR COURT JURISDICTION], India, without affecting any right you have to approach a consumer commission.
13. Contact and grievances
Questions about these terms: [SUPPORT EMAIL], phone [SUPPORT PHONE]. Complaints can be raised with our Grievance Officer, [GRIEVANCE OFFICER NAME] ([GRIEVANCE OFFICER EMAIL]), who will acknowledge them within 48 hours and aim to resolve them within 30 days.
We may update these terms from time to time; the “last updated” date above shows the current version, and we will tell you about significant changes.
